Why would they?

They aren't claiming anything that hasn't been claimed before by countless hair care products for decades.

If you paid attention the part about hair loss has a written disclaimer on screen that says "due to breakage"

Maybe it wasn't on the TV commercial? I have not seen this on TV at all here. But I spend more time on the non big 4 (CBS, NBC, ABC, Fox) so I may be missing out.

Please don't confuse this company with Aveeno. Aveda is not Aveeno.

You're totally right, NotBelievingIt, and that's really why I don't trust the FDA (or even the government for that matter) when it comes to protecting consumers from drugs and products whose benefits are falsely advertised. I oftentimes use the example of how rigorous the government is in requiring such extensive clinical trials for new stem cell procedures yet they totally turn a blind eye to the butchery that has, and is still going on within the hair transplant industry. Countless people have been butchered and permanently disfigured by archaic hair transplants for over 40 years and the government has not done a damn thing to police it.

But yeah, this Aveda is not the only company that is offering false promises and intentionally misleading consumers. I see on TV all of these shampoos that supposedly "nourish" hair (now what the f**k is that supposed to mean?!) and really don't do a damn thing for your hair. Bosley and Hair Club still air commercials that totally mislead people and have been intentionally defrauding people in plain and obvious sight for many, many years. Hell, even the makers of Rogaine are not immune to this. They claim that 85% of users experience hair regrowth, and I highly, highly doubt that this statistic is even close to being true.

The hypocrisy with regards to the FDA and the government and their selective attempts to protect the general public is really staggering and completely unethical.

The FDA couldn't care less about you wasting your money on crap products that don't work. The very reason that they allow these rip off products to be sold is the fact that they do not work. They want nothing to exist on the market that is effective, that big pharma. can't make them money with. For example 2 products that worked and are now history are 15% Minoxidil and Nanogen VEGF serum. I have used and wasted my hard earned $ on everything on the market and these 2 products are the ONLY products that ever gave me any results. I think that you will find a lot of people out there that 15% Minox helped, as for Nanogen VEGF serum, it wasn't around long enough for too many people to try. The reviews from people who have used it, mostly in the U.K. (it is where it's made and still sold) are very favorable.
